Brookshire, charged with the offense of murder in the first degree, was convicted of manslaughter and sentenced to three years imprisonment for the killing of Ralph Collings, one of his farm hands, at defendants farm home about ten miles south of Columbia, Boone County, Missouri. He has appealed. The main contentions in his brief question the jurisdiction of the trial court, the overruling of certain motions on behalf of defendant, the admissibility of certain evidence, the submissibility of the States case, and the courts action with respect to instructions, given and refused.
